Vacation Rentals Community

Help! We have a vacation rental in Klamath, Ca. on 9/12/07 we had a family come in and was only going to stay the weekend. After the weekend they asked for a week and then a month. The contract was written for the date of 9/12/07 - 10/12/07. A couple of days before they were supposed to leave the I called to confirm that they would be out on the 12th because we had another guest coming in. I got a return call saying they had to leave town due to a sick family member (ended up being a court date) and they didn't think they would be out by the 12th. They said they did not have many items their and I offered to store it in the garage until they got back to town. He said I appetite that and I will call you and let you know. On the 11th the day before they were supposed to be out I got a voice mail message saying I can't believe you are trying to illegally get me out of this house and they are going to sue me for discrimination, I had better not step foot in the house or they will sue me for that also. He said he was an attorney and he was going to own my property by the time he was done with me. After doing some research I found that he is a disbarred attorney that got his BA in prison, he cause 20k worth of damage to the last vacation rental about 2 hours away and he is currently going to court for drug charges. My question is, he has been out of the house for 4 days now (on his way to court in another state) we expect he will be back because he left items there. Can I go in and change the looks and put his stuff in storage? Do I have to go thru a 30 day eviction and give him time to destroy my house. We are working with an attorney but vacation rentals seem to be a little bit of a gray area for eviction. Any help of advise would be greatly appreciated.

 I'm really hoping you have this resolved by now. From my experience it is a tough one, as here in Ontario, Canada there is no legislation covering vacation rentals as there is for long term rental. We had a similar problem and eventually had the renters evicted by a  bailiff. The whole episode cost us over $20,000 in damage, lawyers fees and lost income. This is a grey area and we were unable to recover any of the money as the guy never turned up for his court dates, and our legal fees just got too much so we gave up.

 I would love to hear how this ended up.
